AI CONTENT DISCLAIMER, NO GUARANTEE OF ACCURACY, AND ASSUMPTION OF RISK AGREEMENT

• Does not guarantee outcomes of sporting events or other competitions.

2. Subscription Fees and No-Refund Policy

The subscription fee ($20.00 monthly, or $120.00 yearly) is a licensing fee for access to the Betessi LLC proprietary AI tool. This fee is charged for the use of the technology, not for the delivery of "winning" tips or guaranteed outcomes.

All sales are final. Users are not entitled to refunds based on the performance, accuracy, perceived "success" of the AI’s predictions, technical downtime, data latency, or general user dissatisfaction.

3. No Guarantee of Accuracy or Performance

You expressly acknowledge and agree that:

• AI-generated content may be inaccurate or unreliable.
• Predictions are inherently uncertain and subject to numerous unpredictable variables, including player injuries, weather, or referee decisions (Force Majeure).
• Past performance, trends, or statistical models do not guarantee future results.
• No representation or warranty is made regarding the accuracy, completeness, reliability, profitability, or suitability of any information provided.

4. Real-Time Data and Latency Disclaimer

You acknowledge that there may be a latency (delay) between real-world sports events and the AI’s data processing. The Services may not reflect the most current "live" data at the moment a prediction is generated.

5. No Gambling Advice; Informational Use Only

Nothing on this Site constitutes gambling, investment, financial, legal, or professional advisory services. Users are solely responsible for determining whether any activity they undertake complies with applicable laws in their jurisdiction.

6. Assumption of Risk

By using this Site, you knowingly and voluntarily assume all risks associated with:

• Reliance on AI-generated predictions and probabilistic modeling.
• Any wagering or financial decisions made based on Site content.
• Loss of money, profits, or opportunity. You understand that wagering involves substantial risk of loss and that you may lose some or all funds used for betting. Any decision to place a wager is made entirely at your own risk.

7. Limitation of Liability

To the maximum extent permitted by applicable law: The Site, its owners (Betessi LLC), operators, affiliates, and agents (the “Released Parties”) shall not be liable for any financial loss, gambling losses, or indirect, incidental, or consequential damages.

YOU EXPRESSLY AGREE THAT UNDER NO CIRCUMSTANCES SHALL THE TOTAL LIABILITY OF THE RELEASED PARTIES EXCEED THE LOWER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO BETESSI LLC IN THE 30 DAYS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM ($20.00), OR (B) $100.00 USD.

8. Indemnification

You agree to defend, indemnify, and hold harmless the Released Parties from any claims, damages, or expenses (including attorneys' fees) arising out of your use of the Site, your reliance on AI content, or your violation of applicable laws.

9. Cybersecurity and Data Protection

• No Guarantee of Security: No data transmission over the internet is 100% secure. You assume all risks associated with data transmission.
• Data Breach: The Site is not liable for any loss resulting from a data breach unless caused by the Site’s gross negligence.
• User Responsibility: You are responsible for maintaining the confidentiality of your passwords and account security.

10. Age Restriction and Jurisdictional Compliance

The Site is intended only for individuals at least 18 years of age (or the legal age of majority in your jurisdiction). You are responsible for ensuring your use of the Site complies with all local, state, and national laws regarding wagering.

11. Binding Arbitration and Class Action Waiver
